Mahkamah Tinggi pada 7 Jun 2024 memerintahkan Pusat Pakar Tawakal Sdn Bhd dan dua doktornya membayar pampasan RM5.1 juta kepada bekas Ketua Pegawai Eksekutif (CEO) Projek Lintasan Kota Holdings Sdn Bhd (PROLINTAS), Datuk Zainudin A Kadir, selepas mengalami kerosakan otak akibat pembedahan.

Ganti rugi itu perlu dibayar kepada Datin Nor Rizam Abdul Wahab, sebagai isteri dan pentadbir harta Zainudin yang telah meninggal dunia pada 2021 ketika penularan COVID-19.

Hakim, Datuk Mohd Arief Emran Arifin, berkata ia susulan Nor Rizam selaku plaintif berjaya membuktikan bahawa hospital swasta itu bersama dua pakarnya bertanggungjawab atas kecuaian perubatan.

Mohd Arief Emran, juga mengarahkan tiga pihak terbabit membayar RM210,000 sebagai kos kepada pentadbir harta Zainudin.

“Sebahagian besar daripada ganti rugi adalah akibat kehilangan pendapatan kerana mangsa bekerja dan memperoleh RM65,000 sebulan, manakala RM500,000 lagi adalah untuk kesakitan dan penderitaan.

“Bukan fungsi mahkamah untuk menghukum doktor atau hospital tetapi memberi pampasan kepada plaintif.

“Kerosakan otak mangsa kerana dibenarkan keluar awal selepas pembedahan, selain beberapa kejadian lain di wad,” katanya dalam alasan penghakiman bertarikh kelmarin yang dimuat naik menerusi sistem pengurusan e-Kehakiman.

Mengikut fakta kes, Zainudin dimasukkan ke hospital pada 22 Februari 2016 dan menjalani pembedahan hidung empat hari kemudian.

Pembedahan bermula pada jam 5.45 petang dan berakhir jam 8.05 malam, sebelum Zainudin rebah jam 9.30 malam.

Mengikut protokol hospital, doktor mesti memerhati pesakit di ruang pemulihan sekurang-kurangnya sejam selepas ‘reversal anaesthesia’ atau penarikan kembali bius sebelum keluar wad.

Dalam kes ini, pemerhatian hanya berlangsung selama 25 minit sahaja. Memandangkan pesakit masih mengantuk, pakar bedah memasukkan tiub ke dalam esofagus dan bukannya trakea yang membawa kepada kerosakan otak.
